1. Responsible Entity

101 Gen AI, Inc., along with its affiliated entities ("101 Gen AI", "we", "us", or the "Company"), is responsible for processing your Personal Data as detailed in this Privacy Statement. We act as the data controller for this Personal Data, unless stated otherwise.

This Privacy Statement is not applicable in cases where we act as a data processor or service provider on behalf of our customers. This includes situations where our customers:

• Create applications using our platform.

• Offer or sell their own products and services.

• Send electronic communications.

• Collect, use, share, or process Personal Data through our products and services.

In these instances, the privacy practices are determined by our customers. For privacy details related to a customer or a customer affiliate using our products as the controller, please contact the customer directly. Our privacy or data security practices may differ from those of our customers. For more information regarding our role and responsibilities in data processing, please refer to Section 6.3 of this document.


2. Data processing activities covered by this policy

This Privacy Statement applies when you:

1 Visit our websites or branded social media pages that link to this statement.

2 Visit our offices.

3 Receive or engage in communications with us, including emails, phone calls, texts, or faxes.

4 Use our products and services where we act as a data controller.

5 Register for or participate in our events, webinars, programs, or contests.

6 Are associated with a service provider or supplier to 101 Gen AI, in contexts where we act as a data controller.

7 Are employed by a customer of our products and services, and your information is shared with us in our role as a controller.

Third-Party Websites and Partners:

Our websites and services may link to third-party sites, including social media platforms hosting our branded pages. These third parties have their own privacy policies. Additionally, we or our partners may collect publicly available Personal Data, as detailed in our partners' privacy policies available on their websites.

We may collect various types of Personal Data directly from you, depending on the interaction as categorized below:

If you use “Contact us” or similar features; sign up to receive communications; use our products or services; download certain content; or are employed by our customer where your information was shared with us

Information about your device and your usage of our websites or emails (such as  IP addresses or other identifiers), which may qualify as Personal Data (please see Section 4 below) using cookies or similar technologies

If you use and interact with our products and services

Information about your device and your usage of our services through log files and other technologies, some of which may qualify as Personal Data (including Usage Data) (please see Section 4 below)

If you communicate with us via a phone call

Information such as your name, voice and any other Personal Data voluntarily share

If you visit our offices

Name, email address, phone number, company name, time and date of arrival, image or video

If you voluntarily submit certain information to us, such as filling out a survey, responding to a questionnaire or participating in other forms of research

Information you have provided as part of that request, which may include Personal Data and special categories of Personal Data, to the extent you voluntarily choose to provide it

If you are a supplier or service provider to 101 Gen AI (or work for a supplier or service provider)

4. Devices and technologies in use to collect personal information

We use generally available information-gathering tools, such as cookies, pixels, and similar technologies to collect information that may contain Personal Data as you navigate our websites, our services, or interact with emails we have sent to you.

4.1. DEVICE AND USAGE DATA. We collect device and usage data when users visit our websites or use our products and services. This includes:

• Identifiers and internet activity information like IP addresses, device details, location, browser type, Internet service provider, mobile carrier, viewed pages and files, search history, referring sites, operating system, and visit frequency.

• Usage Data from product use, encompassing user IDs, email addresses, device and application IDs, user interactions, operating system type, and product versions used.

This data helps us understand user behavior and improve our services, as detailed in Section 5 of our Privacy Statement. Primarily, it identifies unique users rather than specific individuals, except when necessary for security or service provision.

4.2. COOKIES AND OTHER TRACKING APPLIANCES. We use cookies, pixels, javascript and similar technologies to collect information about website and email interactions. 

Cookies, which may include Personal Data, track online activities over various sites. We use both session-based cookies that disappear after closing the browser, and persistent cookies that stay on to keep the user logged in, or for other purposes described in section 5.

Cookie categories are described in the cookie consent banner that allows opting out of non-essential cookies.

4.3. SOCIAL MEDIA FEATURES. Our websites and emails may include “tweet” and “share” buttons that allow you to post information shared by us to social media. When used, these buttons may share your website usage information with the social media network.

Additionally, Logging into our websites using social media sign-in services may share certain Personal Data with us.

Interactions with these features are subject to the privacy policies of the respective social media networks.

6.1. YOUR RIGHTS. You have rights to access, rectify, erase, restrict, transfer, and object to processing of your Personal Data. You can also opt out of data sharing for non-essential advertisements and automated decision-making, and withdraw consent where applicable. Discrimination for exercising these rights is prohibited.

6.2. EXERCISING YOUR RIGHTS. Contact us as detailed in Section 8 to exercise your rights. We respond within one month and may require additional information for identity verification.

6.3. RIGHTS RELATED TO CUSTOMER DATA: For Personal Data processed on behalf of a customer, contact the customer directly. We will assist the customer in responding to your requests.

6.4. EMAIL AND SMS MARKETING COMMUNICATIONS: You can unsubscribe from marketing communications via the unsubscribe link in emails, by texting 'STOP' for SMS, or through the contact information in the "Contacting us" section.

6.5. TELEMARKETING COMMUNICATIONS: To be added to our Do-Not-Call register, provide your details as per Section 8. You can also request not to be called again during a telemarketing call.


7. How we secure personal information

We take various steps, including organizational, technical, and physical measures, to protect your Personal Data from accidental loss, alteration, unauthorized access, or misuse. However, remember that no data storage or transmission method is completely secure. It's important for you to keep your password safe, limit access to your devices, and log out after using websites.
